Terms of Service

RPE Trainer provides services that let users store and analyze training data, data about athletic fitness, and other content the user uploads, syncs from other accounts, or enters manually through their account.

1. Definitions

  • Personal data — information relating to an identified or indirectly identifiable natural person.
  • User — a person using the RPE Trainer service, possibly in different roles.
  • Researcher — a person who analyzes data entered by athletes and provides feedback based on it.
  • Service — the RPE Trainer software, available both as a web environment and a mobile application.
  • Terms of Service — this agreement together with all current and future amendments and annexes.
  • Privacy Policy — the set of rules governing data processing and obligations, binding on both the user and the service provider.
  • GDPR — the European Union's General Data Protection Regulation (EU 2016/679).

2. Users and roles

An athlete can enter training-related data into the software, such as workout data (distance, speed, etc.) and wellness data (muscle soreness, stress level, etc.). The user can also enable automatic synchronization with third-party training platforms by authorizing RPE Trainer to fetch the relevant data.

A researcher analyzes the data entered by athletes and, as agreed, provides feedback to the athlete or their coach. The researcher must ensure the security of the analyzed data and may not pass it on to third parties.

By agreement, a researcher may use collected data in anonymized form in research, presenting data as aggregate values and ensuring the athlete's anonymity in all cases.

3. User obligations

When using the service, you must take all necessary measures to keep the personal data you enter secure. You may not share your username, password, or any access containing information about you with third parties, and you are fully responsible for their security.

All actions performed with your username and password, or through the authenticated mobile application, are considered performed by you, unless you have previously notified RPE Trainer of third-party access to your account or the loss of your credentials.

To use RPE Trainer you must be at least 13 years old or have the consent of a parent or guardian.

4. RPE Trainer's obligations

  • RPE Trainer provides users access to the service except when circumstances beyond RPE Trainer's control arise.
  • RPE Trainer applies all reasonable technical and organisational measures to protect the data it holds.
  • RPE Trainer stores and processes all account data in accordance with the Privacy Policy and applicable law.
  • RPE Trainer acts as a data processor on behalf of its users.
  • Personal data is processed when the user chooses to store their data in the application.
  • Access to personal data is limited to researchers who need it for their work and who are bound by confidentiality obligations.
  • At the user's choice, RPE Trainer deletes or returns all personal data when the provision of the service ends, unless law requires the data to be retained.
  • RPE Trainer uses sub-processors only where necessary for the application to function; the Privacy Policy terms and confidentiality requirements apply to them as well.

5. Liability and other terms

Researchers and RPE Trainer are not liable for accidents, injuries, or direct or indirect damages that may occur to the user during training or through use of the service, including due to service interruptions, data loss, or inaccurate information shared by other users.

Using the service through any means other than the user interface provided by RPE Trainer is prohibited. Use of the service through automated means (including scripts or web crawlers) is strictly prohibited.

RPE Trainer reserves the right to briefly interrupt the service for maintenance, notifying users 2 days in advance where possible. If the service is discontinued, RPE Trainer will notify users 90 days in advance.

These Terms of Service are governed by the laws of the Republic of Estonia. All disputes are resolved through negotiation or under the applicable procedural law of the Republic of Estonia.

If any provision of these terms proves invalid, the validity of the remaining terms is not affected.

6. Intellectual property

The user is granted a limited, revocable, personal, non-transferable, and non-exclusive license to use the application and its services. The user may not modify, rent, lease, lend, sell, distribute, create derivatives of, or attempt to extract the source code of the RPE Trainer application or any part of it.

7. Termination

The user may terminate this agreement at any time by deleting their account. The user can request an export of their personal data and ask for its deletion at any time. Anonymized data that can no longer be linked to the user may be used in research even after account deletion.

RPE Trainer may terminate the agreement immediately if the user has violated these terms or acted in a way that harms or could harm the service, other users, or RPE Trainer's reputation.

8. Updates to these terms

RPE Trainer reserves the right to amend these Terms of Service, notifying users of changes by email and/or through the service.
